Buying at Maison Bibelot

MAISON BIBELOT S.r.l. acts as agent with representation of those, the principals, who deliver works to it for sale at auction or by private treaty.
The effects of the sale directly affect the seller-client and the buyer, without Maison Bibelot S.r.l. assuming any liability other than that arising from the mandate received. MAISON BIBELOT S.r.l. assumes towards seller-sellers and purchasers exclusively the responsibilities arising from this capacity.

How to participate in the auction

To purchase at the auction, it is necessary to register one's personal details (valid identity document, tax code and bank references), prior to the start of the sale, through the website www.maisonbibelot.com. By registering, the buyer expressly declares under his/her own responsibility that he/she has read the General Terms and Conditions of Sale of MAISON BIBELOT S.r.l. and that he/she has fully accepted them. Sales shall be made to the highest bidder. Participation in the auction is personal. The successful bidder is responsible for payment. Any participation in the name and on behalf of third parties must be previously and expressly authorised in writing by MAISON BIBELOT S.r.l., which for this purpose may require the filing of an authenticated power of attorney and adequate bank references.


Goods to be sold

The goods being sold at auction or by private treaty, due to their nature and antiquity, may show signs of wear, defects, other imperfections, restorations or repairs.
We always recommend viewing the work directly in order to personally ascertain its characteristics, state in use, state of preservation, dimensions, qualities, authenticity, attribution and provenance. Those who are unable to view the work directly have the possibility of requesting a condition report from the department concerned.
The purchaser assumes responsibility for his choices and accepts any interventions and defects that are known or easily recognisable at the time of adjudication or that cannot be ignored with due diligence.


Catalogue descriptions

The pictures, illustrations, descriptions and definitions of the individual works contained in the catalogue are purely indicative and merely an expression of the opinion of our experts. Auction price

The adjudication price is the price at which the lot is awarded at auction, in the case of a private sale, the price agreed upon between MAISON BIBELOT S.r.l. and the buyer, net of the auction fee and VAT.


Auction Consideration

In addition to the adjudication price, the purchaser must pay an auction consideration, for each lot, equal to 27% on the adjudication price up to € 100,000 and 25% on the excess amount, inclusive of VAT and taxes.
The purchaser shall pay an auction fee calculated on the adjudication price of each lot as follows 22.13% on the first € 100,000.00 and 20.49% on the amount exceeding € 100,000.00. VAT of 22% must be added to this auction fee, in addition to any VAT due on the adjudication price.


Value Added Tax

The VAT payable by the buyer is 22% on the net auction price. Therefore, the final price will be the sum of the adjudication and a total of 27% on the first € 100,000.00 and 22% on the excess amount.


Transfer of Ownership

Transfer of ownership to the purchaser occurs upon payment.


Purchase payment

Payment of the adjudication price, the auction consideration and any other expenses due by the purchaser to MAISON BIBELOT S.r.l. can be made at the offices of MAISON BIBELOT S.r.l. in Florence, Corso Italia n. 6, on the same day or, in any case, no later than the week following the sale. Payment may be made:
(a) in cash up to € 2,999.99;
(b) by bank draft or by non-transferable bank cheque subject to verification with the issuing bank made out to MAISON BIBELOT S.r.l;
(c) Bancomat or credit cards
(d) by bank transfer to Intesa Sanpaolo SpA - Via Il Prato, Florence

If payment is made in cash, by bank draft or by credit card, the goods purchased shall be immediately made available to the purchaser; in all other cases, they shall be made available to the purchaser following verification of successful payment.
In the event of failure by the successful bidder to pay in full within the terms established in this article, MAISON BIBELOT S.r.l. may request the fulfilment or termination of the contract, subject to a warning to fulfil, without prejudice in any case to compensation for damages and payment of the auction price and any expenses incurred.


Collection of purchased lots

Unless otherwise indicated, it will only be possible, upon payment, at the offices of MAISON BIBELOT S.r.l. in Florence Corso Italia n. 6, or at other locations as indicated in the catalogue. Failing payment, MAISON BIBELOT S.r.l. will refuse delivery.
Collection shall be made no later than the deadline set for each auction. After this deadline, storage costs of uncollected goods may be charged.
The costs of dismantling, packing, transport and insurance shall be borne entirely by the buyer. Upon request, MAISON BIBELOT S.r.l. may suggest the name of a carrier, but such indication shall not imply any liability for MAISON BIBELOT S.r.l.


Export of Goods

Legislative Decree No. 42 of 22 January 2004 regulates the export of Cultural Goods outside the territory of the Italian Republic, while export outside the European Community is also subject to the regulations set out in EEC Regulation No. 116/2009 of 18 December 2008. The export of objects is governed by the aforementioned regulations and the customs and tax laws in force. MAISON BIBELOT S.r.l. is not responsible for the issuance of the relevant permits nor can it guarantee their issuance. MAISON BIBELOT S.r.l. therefore declines all responsibility towards purchasers with regard to any restrictions on the export of the lots awarded. Failure to grant the aforementioned authorisations cannot justify cancellation of the purchase or non-payment. 

Purchasers are required to comply with all applicable laws and regulations pertaining to the notified objects, with particular reference to Legislative Decree No. 42/2004. The sale of objects subject to the aforesaid regulations shall therefore be subject to the non-exercise of the right of pre-emption by the competent Ministry within the term of sixty days from the date of receipt of the notification as provided for by Article 61 of the aforesaid Legislative Decree No. 42/2004. During the term for the exercise of the right of pre-emption, the property may not be delivered to the purchaser pursuant to Article 61, paragraph 4, of Legislative Decree No. 42/2004. The successful bidder may not, in the event of the exercise of the right of first refusal by the State, claim from MAISON BIBELOT s.r.l. or the Seller any reimbursement or indemnity.


Resale right

If indicated in the catalogue, certain lots may be subject to the resale right. Legislative Decree No. 118 of 13 February 2006 introduced the right of authors of works and manuscripts, and their heirs, to a fee on the sale price, subsequent to the first, of the original work, the ‘resale right’.
This fee is due if the sale price is not less than €3,000 and is determined as follows:
1. 4% for the part of the sale price between €3,000 and €50,000
2. 3% for the portion of the sale price between €. 50,000.01 and €. 200,000
3. 1% for the portion of the sale price between €. 200,000.01 and €. 350,000
4. 0.5% for the portion of the sale price between €350,000.01 and €500,000
5. 0.25% for the portion of the sale price exceeding €. 500,000

MAISON BIBELOT s.r.l. is obliged to pay the ‘resale right’ on behalf of the sellers to the Società Italiana degli Autori ed Editori (SIAE). In the event that the lot is subject to the ‘resale right’ pursuant to Art. 144 of Law 633/41, the successful bidder undertakes to pay, in addition to the adjudication, auction commissions and any other expenses that may be charged, also the amount that
would be due to the Seller to pay pursuant to art. 152 of Law 633/41, which MAISON BIBELOT S.r.l. undertakes to pay to the person in charge of the collection.


Disputes

In the event of a dispute, the exclusive jurisdiction of the Court of Florence shall be established, except in the event that the provisions of Legislative Decree 206/2005 (the so-called Consumer Code) are applicable.
